This Privacy Policy describes how your personal information is collected, used, and shared when you visit or submit a form on https://creativeempulse.com (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual webpages that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. The cookies used on the Site are from our host Squarespace. Additionally, when you sign up for our mailing list or request a commission through the Site, we collect certain information from you, including your full name and email address.  We refer to this information as “Contact Information.”

 When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Contact Information.

 HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Contact Information that we collect generally to fulfill any commission requests placed through the Site (including providing you with order confirmations and/or invoices). 

 Additionally, we use this Contact Information to:

  • Communicate with you;

  • Screen commission requests for potential risk or fraud; and

  • Provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our visitors browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

 SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

DO NOT TRACK

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

 YOUR RIGHTS

If you are a European resident, you have the right under the General Data Privacy Regulation (“GDPR”) to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. Your data protection rights include:

  • Right to Access – You have the right to request copies of your personal data. There is no fee for this service.

  • Right to Rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.

  • Right to Restrict Processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.

  • Right to Object to Processing – You have the right to object to our processing of your personal data, under certain conditions.

  • Right to Data Portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

  • Right to File a Complaint – You have the right to file a complaint with a supervisory authority about our collection and processing of your personal data.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you request a commission through the Site), or otherwise to pursue our legitimate business interests listed above.  Please note that your information will be transferred outside of Europe, including to the United States where we are based.

  •  Right to Request Information – You have the right to request what personal information and/or categories of information that we have collected on you, how we collect it, and what we use it for.

    Note: We generally collect personal information in the form of first and last name, email address, IP address, browser information, and basic personal information such as audience demographics (age, gender, location, etc.) and behavior (pages visited, links clicked, etc.). We collect this information through cookies, Squarespace Analytics, and the forms that you submit through the Site when you sign up for our mailing list or request a commission.

  • Right to Erasure – You have the right to request that we erase your personal data, under certain conditions.

  • Right to Disclosure – You have the right to know if a company sells your information to a third party and the right to request that a company does not sell your information. We do not sell your information to anyone, ever. Right to Fair Treatment – You have the right to fair treatment should you choose to exercise the above rights. You will retain access to the same products and quality of services as everyone else.

DATA RETENTION

When you sign up for our mailing list or request a commission through the Site, we will maintain your Contact Information for our records unless and until you ask us to delete this information.

CHILDREN’S PRIVACY

The Site is not intended for individuals under the age of 13. We do not knowingly collect personal information from children under the age of 13 without parental consent. If we receive personal information that we discover was provided by a child under the age of 13, we will promptly destroy such information.

CHANGES

We may update this privacy policy from time to time in order to reflect changes to our practices or changes made for other operational, legal, or regulatory reasons. If you continue to visit this Site and use the services made available to you after such changes have been made, you hereby provide your consent to the changes.
